Cit� of ORONO �� <br /> • RESOLUTION OF THE CITY COUNCIL � <br /> � NO. 2638 <br /> • � • • <br /> _ � <br /> r, <br /> 2. The property is located in the B-2 Lakeshore Business <br /> Zoning District requiring a minimum of 2 acres of area. The <br /> marina property divided by County Road 15 consists of 1.815 <br /> acres within the east portion of the property and 1.35 acres <br /> within the west portion of the property for a total of 3.281 � <br /> acres. <br /> 3. The Orono Council reviewed this application on May 8, <br /> 1989, and conceptual ly approved the proposed variances and ; <br /> conditional use permit based upon one or more of : <br /> the following findings and hardships: : <br /> K <br /> _ <br /> h <br /> A) The east and west portions of the marina property � <br /> are not deep enough to allow an expansion of the : <br /> parking area that would meet the required lakeshore , <br /> setback. � <br /> • B) The current pattern of docks on the west and east <br /> side with parking provided only on the east has existed <br /> for this marina for over 40 years without mishap. <br /> C) The majority of the property is located within the . <br /> lakeshore protected area where no hardcover is allowed. . <br /> D) The property has been used as a commercial marina � <br /> for over 40 years. <br /> E) Based on County and City records there have been no <br /> personal injury or property damage resulting from the � <br /> cross-over use of the clients of either Windward Marine <br /> or Minnetonka Boat Works. The accident records of the <br /> City from 1985 to the present reveal only 5 accidents. ; <br /> None of these accidents were related to the cross-over <br /> activities of the clients of the marina properties. <br /> F) Drainage/run-off will be improved by providing re- <br /> direction of surface run-off into a retention pond for <br /> treatment rather than draining directly into the lake <br /> per current pattern of drainage. <br /> G) The applicant, represented by Irwin Jacobs, has <br /> agreed to work with the City to improve the level of <br /> � safety for the users of the county road and the marina <br /> facilities in the area. The applicant plans to install <br /> appropriate "No Trespassing" signage and provide <br /> additional personnel to patrol the area. <br /> Page 2 of 8 <br />
