I City of ORONO <br />RESOLUTION OF THE CITY COUNCIL <br />NO. 2589 <br />A RESOLUTION GRANTING <br />VARIANCES TO <br />MUNICIPAL ZONING CODE <br />SECTION 10.23, SUBDIVISION 6 (B) <br />FILE NO. 1371 <br />WHEREAS, Robert Minkema (hereinafter "the applicant") is the <br />owner of the property located at 3200 Bayside Road within the City of <br />Orono (hereinafter "City") and legally described as follows: <br />Lot 14, Auditors Subdivision #203, Hennepin County, Minnesota <br />(hereinafter "the property"); and <br />WHEREAS, the applicant has applied to the City of Orono for a <br />variance to'Municipal Zoning Code Section 10.23, Subdivision 6 (B) to <br />permit the construction of additions to his existing residence, which <br />•additions will be located less than the required 50' setback from the front <br />street lot line and less than the required 50' setback from the side street <br />lot line. <br />NOW, THEREFORE, BE IT RESOLVED by the City Council of Orono, <br />Minnesota: <br />FINDINGS <br />1. This application was reviewed as Zoning File #1371. <br />2. The property is located in the LR-lA Single Family Lakeshore <br />Residential Zoning.District. <br />3. The Orono Planning Commission reviewed this application on <br />February 21, 1989 and recommended approval of the proposed variance <br />based upon the following findings: <br />a. The existing residence is located entirely within the <br />required front and side street setbacks, and therefore any <br />additions to the existing residence require a variance. . <br />b. The plight of the landowner is due to circumstances unique <br />to this property not created by the landowner. <br />C. Granting of the variance will not alter the essential <br />. character of the locality. - <br />d. The special conditions applying to this structure are <br />peculiar to this property. <br />Page 1 of 4 <br />
