The existing residence is unusually close to the front and <br />side street lot lines, which is unusual for properties in the LR - <br />1A zoning district generally. <br />f. Granting of the variance is necessary for the preservation <br />and enjoyment of a substantial property right of the applicant. <br />g. The granting of the proposed variance will not in any way <br />impair health, safety, comfort, morals, or in any other respect <br />be contrary to the intent of the zoning code. <br />h. The granting of this variance will not merely serve as <br />convenience to the applicant, but is necessary to alleviate <br />demonstrable hardship or difficulty. <br />4. The City Council has considered this application including the <br />• findings and recommendations of the Planning Commission, reports by <br />City staff, comments by the applicant and the effect of the proposed <br />variances on the health, safety and welfare of the community. <br />5. The City Council finds that the conditions existing on this <br />property are peculiar to it and do not apply generally to other <br />property in this zoning district; that granting the variances would <br />not adversely affect traffic conditions, light, air nor pose a fire <br />hazard or other danger to neighboring property; would not merely serve <br />as a convenience to the applicant, but is necessary to alleviate a <br />demonstrable hardship or difficulty; is necessary to preserve a <br />substantial property right of the applicant; and would be in keeping <br />with the spirit and intent of the Zoning Code and Comprehensive Plan <br />of the City. <br />CONCLUSIONS, ORDER AND CONDITIONS <br />Based upon the above findings, the Orono City Council hereby <br />grants a variance to Municipal- Zoning Code Section 10.23, Subdivision 6 (B) <br />to permit the construction of additions to the existing residence which <br />will be located 33.8' from the side street lot line where a 50' side street <br />setback is normally required, and 18.4' from the front lot line where a 50' <br />front setback is normally required, subject to the following conditions: <br />1. Any changes to the site <br />will place the residential <br />• than the proposed setbacks <br />plan (attached herein as Exhibit <br />A) <br />which <br />additions closer to the <br />affected <br />lot <br />lines <br />will require additional <br />review by <br />the <br />City. <br />Page 2 of 4 <br />
