J <br /> � �::� : � � c�t o� oR,oNo <br /> � <br /> • `�.� �(�� RESOLUTION OF THE CITY COUNCIL <br /> � NO. 2473 <br /> ` • - � � <br /> WHEREAS, it is intended that the private road be privately owned <br /> and maintained. It is intended that Outlot A shall be developed as a <br /> private road, and that Outlot B shall be developed at such time that Lot 3, <br /> Block leis divided into two or more lots. Further, a separate right-of-way <br /> outlot, shown on the plat as Outlot C, is intended for purposes of <br /> providing for a future connection between the proposed private road and the <br /> plat road preliminarily approved for the plat of Lot 2, Block l, Foxwood, <br /> so that .these two roads may be .connected if deemed necessary in the future; <br /> and <br /> WHEREAS, the subdivider has completed all the requirements of the <br /> City, including: <br /> 1. Comp letion of a 11 the requirements of Resolution No. 2239. <br /> 2. Dedication on the plat of rights-of-way for public streets and <br /> roads shown as County Road 84. <br /> . 3. Creation of a new private road shown on the plat as Outlot B to be <br /> known henceforth as Rainey Road. <br /> 4: Concurrent with the creation of this private road, the subdivider <br /> ' has dedicated a ,road and utilities easement granting to the City <br /> permanent access, improvement and utility easements over said outlots; <br /> the subdivider has created non-exclusive ingress, egress, drainage and <br /> utility easements over said outlots in favor of all abutting and/or <br /> benefitting lots including a declaration of certain maintenance <br /> covenants wherein each of the abutting or benefitting lot owners <br /> agrees to permanently maintain and pay the costs of maintenance for <br /> said private road. <br /> 5. Dedication to the City of a Flowage and Conservation Easement <br /> providing for limitations on the use of wetlands and/or drainageways <br /> described therein and shown on the plat as "drainage easements". <br /> 6. Execution of a Subdivider's Agreement providing for installation <br /> of certain improvements as a condition of subdivision approval. <br /> 7. Payment to the City of a Park Dedication Fee in the amount of <br /> . $900.00. <br /> 8. Payment to the City for of final plat administrative fee and fee <br /> for the legal review and filing of the plat easements and covenants in <br /> the amount of $300.00. <br /> ' • NOW, THEREFORE BE IT RESOLVED, that the City Counci 1 of the City <br /> of Orono hereby approves the plat of Trees To Be, Hennepin County, <br /> Minnesota; subject to the following conditions: <br /> , Page 2 of 3 <br />
