RESOLUTION OF THE CITY COUNCIL <br /> . � NO. 2473 . <br /> • � • • <br /> A ItESOLDTION APPROVING THE PLAT OF , <br /> TREES TO BE <br /> FILE NO. 1128 <br /> WHEREAS, the City of Orono is a municipal corporation organized <br /> and existing under the laws of the State of Minnesota; and <br /> WHEREAS, the City Council of the City of Orono has adopted <br /> subdivision regulations for the orderly, economic and safe development of <br /> land within the City; and <br /> WHEREAS, the City Council has considered the application for a <br /> subdivision by Rainey Anderson, the subdivider; and <br /> WHEREAS, on August ].0, 1987, the City Council approved Resolution <br /> No. 2239, granting preliminary approval for a plat at 780 South Old Crystal <br /> Bay Road; and <br /> • WHERBAS, the proposed p lat contains six (6 ) lots each exceeding <br /> the 2.0 acre minimum lot area requirement. Lots 2 and 3 , Block 1 and Lots <br /> 2 and 3, Block 2 require a variance because they do not have frontage on a <br /> public roadway. Al1 six (6) lots are proposed to front on and access to a <br /> � private road. Lot 2, Block 1 and Lot 3, Block 2 require a variance because <br /> they do not contain the required 200' lot width as measured at the 50' <br /> front setback line from the cul-de-sac, but do meet the 200' width standard <br /> when private road Outlot B is considered as part of the front lot line. <br /> Lot 3, Block 1 requires a variance because it does not have 200' of <br /> frontage abutting Outlot B, but does exceed 200' in all dimensions; and <br /> WHEREAS, the subdivision has been found to meet aIl other <br /> standards of the RR-1B zoning district finding that each lot is of a size <br /> and configuration that wil 1 allow its use as a single family residence to <br /> be fu11y developed without" the need of further variances; and <br /> WHERBAS, Lots 1 and 2, Block 1 and Lots 1, 2, and 3, Block 2 have <br /> been demonstrated to contain suitable sites for primary and alternate <br /> drainfields to serve the proposed single family residences. Lot 3, Block 1 <br /> exceeds 5.0 acres in dry buildable area, hence testing is not required <br /> � :until that lot is proposed for a single residence or further subdivided; <br /> and <br /> WHEREAS, no additional right-of-way for South Old Crystal Bay <br /> Road (County Road 84) outside the existing right-of-way is required by the <br /> City; and <br /> : • <br /> Page 1 of 3 <br /> . , <br />
