MINUTES OF THE <br /> ORONO PLANNING COMMISSION MEETING <br /> Monday,May 20,2002 <br /> 6:30 o'clock p.m. <br /> (#02-2780 OTTEN BROTHERS NURSERY, Continued) <br /> Hawn asked for public comment regarding the screening issues, as noted in the other issue section of the <br /> application. <br /> Joel Walvatne, 710 Dickey Lake Drive, stated that he has had issue with Otten Brothers since 1989. He <br /> voiced complaint over ineffective screening along the back of the property,the loading dock, and retail <br /> area of lot C, which houses the nurseries front end loader. He added that the front end loader often runs <br /> late at night making noise a huge concern. <br /> Hawn stated that it sounds as if both parties would benefit from a fence. <br /> Neither party was willing to pay for it. <br /> Hawn suggested consideration be given to the back access road,no longer necessary in light of the <br /> Highway 12 relocation. <br /> Weinberger pointed out that outlot A was set up as a buffer area originally. <br /> Hawn brought up the potential for arbitration. An ongoing situation since 1989,the City should help to <br /> come up with a solution which would not leave any ongoing responsibility of either party. She suggested <br /> that a trained mediator be hired in order to resolve this issue. <br /> Gaffron concurred, stating that an independent unbiased perspective would be helpful. <br /> Both parties agreed to work with a mediator to come up with a final solution. <br /> (#4)#02-2776 HENNEPIN COUNTY,3880 SHORELINE DRIVE,RENEWAL VARIANCES <br /> Hawn moved, Smith seconded,to table Application#02-2776 Hennepin County,3880 Shoreline <br /> Drive, as no representatives for the Applicant were present. VOTE: Ayes 7,Nays 0. <br /> (#14) PLANNING COMMISSION APPROVAL OF MINUTES FOR APRIL 15,2002. <br /> Kluth changed the word `now' to `not' on p. 22,the first line. <br /> Kluth moved,Hawn seconded,to amend the Minutes of April 15,2002 on page 22,line 1,changing <br /> the word `now' to `not'. VOTE: Ayes 7,Nays 0. <br /> PAGE 27 <br />
