MINUTES OF THE ORONO PLANNING COMMISSION <br /> JUNE 19, 2000 <br /> (#2595 SHARON TAPANI, CONTINUED) <br /> The Certificate of Mailing and Affidavit of Publication were noted. <br /> Bottenberg stated the Applicant has filed an conditional use permit application to allow plumbing <br /> in an accessory building. The 10' x 20' accessory building will be used as a"pool house"and <br /> will be located next to the pool for the storage of pool equipment. The accessory building will <br /> include a bath/changing room with sink,toilet and shower. <br /> The Applicant has been issued a building permit to begin construction on this project since the <br /> proposed building does meet all setback requirements. <br /> Bottenberg stated the Planning Commission will need to make a finding on whether the proposed <br /> use for the accessory structure with plumbing will not be detrimental to the residential character <br /> of the neighborhood and find that the plumbing fixtures proposed are in keeping with the intended <br /> use of the accessory building. <br /> Bottenberg noted the accessory building is conforming in location, size and height, and the property <br /> is 2.153 acres in size, which exceeds the acreage requirements for that district. The property owner <br /> agrees to file a covenant in the title of the property providing that the accessory building will not be <br /> used for a home occupation unless specifically approved by City or if allowed by City Code; <br /> that the accessory building will not be used as a dwelling unless a guest house CUP is obtained; <br /> • and that the accessory building will not be rented, leased or otherwise provided for use as dwelling <br /> under any circumstances. <br /> Erotas indicated he has read the Planning Report and does not have anything to add. <br /> It was the consensus of the Planning Commission that the application met the five criteria outlined <br /> in the Planning Report. <br /> Hawn inquired whether the Applicant was agreeable to the filing of a covenant on the property <br /> restricting the use. <br /> Erotas stated the Applicant is agreeable to the covenant,noting that the use of the pool is very <br /> limited. <br /> Gaffron indicated a form will be provided to the Applicant to fill out relating to the covenant. <br /> There were no public comments regarding this application. <br /> Hawn moved, Smith seconded,to recommend approval of Application#2595, Sharon Tapani, <br /> 781 Ferndale Road North, and grant a Conditional Use Permit to Allow Plumbing in an <br /> Accessory Building Adjacent to the Pool, subject to the property owner filing certain <br /> covenants on the title to the property. VOTE: Ayes 4,Nays 0. <br /> 4110 <br /> PAGE 4 <br />
