' <br /> D) The existing non-conforming garage will be removed and the <br /> � proposed attached garage will meet the required street and side <br /> lot line setbacks. <br /> 4. The applicant has proposed a driveway configuration that will <br /> allow a net decrease of 0.5$ hardcover in the 75-250' zone, but does <br /> not allow for a backup apron. The Council finds that for safety <br /> purposes, a backup apron should be provided to avoid forcing vehicles <br /> • to back onto County Road 19. <br /> 5. The Council finds no harclship to justify granting of a hardcover <br /> • increase in the 0-75' setback zone. <br /> 6. The City Council has considered �this application including the <br /> � findings and recommendations of the Planning Commission, reports by <br /> City staff, comments by the applicant and the effect of the proposed <br /> variance on the health, safety and welfare of the community. <br /> 7. The City Council finds that the conditions existing on this <br /> property are peculiar to it and do not apply generally to other <br /> property in this zoning district; that granting the variance would not <br /> adversely affect traffic conditions, light, air nor pose a fire hazard <br /> or other danger to neighboring property; would not merely serve as a <br /> convenience to the applicant, but is necessary to alleviate a <br /> demonstrable hardship or difficulty; is necessary to preserve a <br /> substantial property right of the applicant; and would be in keeping <br /> with the spirit and intent of the Zoning Code and Comprehensive Plan <br /> � of the City. <br /> CONCLIISIONS, ORDER AND CONDITIONS - <br /> Based upon the above findings, the Orono City Council hereby <br /> grants a variance to the Municipal Zoning Code Sections � 10.55, Subdivision <br /> • 8 and 10.22, Subdivisions 1 and 2 to permit the construction of an addition <br /> and attached garage which may constitute additional structure in the 0-75' <br /> lakeshore setback zone where structure is normally not allowed, but wil 1 <br /> not increase 0-75' hardcover above the existing 17.5$, and which will <br /> increase the hardcover in the 75-250' setback zone from the existing 27.3� <br /> to no greater than 29.0$, subject to the following conditions: <br /> Page 2 of 4 <br />
