There is no additional land available to bring the lot width or lot area into <br /> confonllitv. <br /> d. The proposed residence n�eets the structural lot coverage limitation of 15%. <br /> e. The proposed residence complies with all lake yard, side yard, rear (street) <br /> yard, and avera�e lakeshore setback and hardcover requirements. <br /> 4. Tl�e City Council has considered this application including the findings and <br /> reconunendation of the Plannin� Cominission, reports by City staff, cominents by <br /> the applicants and the public, and the effect of the proposed variance on the <br /> health, safety and welfare of the community. <br /> 5. The City Council finds that the conditions existing on tl�is property are peculiar to <br /> it and do not apply generally to other property in this zoning district; that granting <br /> the variance would not adversely affect traffic conditions, light, air nor pose a fire <br /> hazard or other danger to neighboring property; would not merely serve as a <br /> convenience to the applicants, but is necessary to alleviate a demonstrable <br /> hardship or difficulty; is necessary to preserve a substantial property right of the � <br /> applicants; and would be in keeping with the spirit and intent of the Zoning Code <br /> and Comprehensive Plan of the City. <br /> CONCLUSIONS, ORDER AND CONDITIONS <br /> Based upon one or more of the above findin�s, the Orono City Council hereby grants a <br /> variance to Orono Municipal Zoniz�g Code Section 78-350 Subdivision B to allow <br /> redevelopment of a lot with �9 feet in width at the OHWL and 65 feet in width at the 7�-foot <br /> setback fi-om the OHWL where 100 feet in width is nonllally required in order to construct a new <br /> residence, subject to tl�e followin� conditions: <br /> l. Council approval is based on the survey and buildin� plans submitted by the applicants <br /> and annotated by City staf£ attached to this Resolution as Exhibits A & B. Anv <br /> amendments to the site plan which are not in conformity with City codes will require <br /> further Planning Commission and City Council review. <br /> 2. Hardcover in Che 0-7�' zone shall not inc�rease above tl�e level of 128 s.f. or 2.5%. <br /> Hardcover in the 7�-250' zone shall be limited to 3,234 s.f. or 25%; hardcover within the <br /> 250'-500' zone shall be linlited to 3,807 s.f. ar 30% per the proposed plan and hardcover <br /> allowance summary as depicted on Exhibit A.
