The property is located in the LR— 1 C, One Family Lakeshore Residential <br /> District, which requires a ininimum lot area of 0.50 acres and a minimuin <br /> lot width of 100'. The applicant's lot is 0.37 acres in area and 52' in width <br /> at the shoreline and 57' in width at the 75' setback. <br /> 3. The Plannin� Commission reviewed this application at a public hearing <br /> held on March 19, 2007 where a recommendation was made to approve <br /> the variances for the new home based on the following findings: <br /> a. The applicant has agreed to remove any excess hardcover, including a <br /> concrete staircase along the south side of the home, within the 0-75' <br /> lake setback zone. <br /> b. The size footprint proposed is smaller than that of the other homes in <br /> the immediate neighborhood. <br /> c. The levels of hardcover and sti-uctural coverage on the property were <br /> previously approved by the City Council by Resolution Nos. 3213 & <br /> 3329. The applicant's current proposal does not exceed the limits <br /> approved for the property. <br /> 4. The City Council has considcrcd this applicatio:� inc.uding t�:e ti�uin�s <br /> and recommendation of the Planning Commission, reports by City staff, <br /> comments by the applicant and the public, and the effect of the proposed <br /> variance on lhe healih, safety and weliare of the community. <br /> 5. The City Council finds that the conditions existing on this property are <br /> peculiar to it and do not apply generally to other property in this zoning <br /> district; that granting the variance would not adversely affect traffic <br /> conditions, light, air nor pose a fire hazard or other dan�er to neighboring <br /> property; would not merely serve as a convenience to the applicant, but is <br /> necessary to alleviate a demonstrable hardship or difficulty; is necessary to <br /> preserve a subsiantial property right of tne applicant; and wouid be in <br /> keeping with the spirit and intent of the Zoning Code and Comprehensive <br /> Plan of the City. <br /> Pa�e ? of 5 <br />
