� �� <br /> O O <br /> �'�����- CITY of ORONO <br /> ,� , � <br /> , ; � <br /> �� G~' RESOLUTION OF THE CITY COUNCIL <br /> L�kESHOg'� No. 5 6 0 3 <br /> CONCLUSIONS, ORDER AND CONDITIONS <br /> Based upon one or more of the above findings, the Orono City Council hereby <br /> grants variances to Orono Municipal Zoning Code 78-350 to allow side yard setback <br /> variance for the lst and 2"d levels of the proposed home to be set back as close as 5.3' to <br /> the side lot line where a 10' setback is required and a 5.3' setback currently exists in <br /> order to re-use the existing foundation of the home; and Orono Municipal Zoning Code <br /> Section 78-1288 to allow hardcover within the 0-75' zone of 21.4% (909 s.f.) hardcover <br /> where 0% is normally aliowed and 21.4% currently exists, and to allow hardcover within <br /> the 75'-250' zone of 32.3% (3,637 s.f.) hardcover where 25% is normally allowed and <br /> 31.4% currently exists, and within the 250'-500' zone for 36.8% (284 s.£) hardcover <br /> where 30% is normally allowed and 36.8% currently exists; and Orono Municipal Zoning <br /> Code 78-1403 to allow 16.2% where 15% is normally allowed and 15.6% currently exists <br /> subject to the following conditions: <br /> l. Council approval is based on the building and site plans submitted by the <br /> applicant and annotated by City staff, attached to this Resolution as Exhibits A & <br /> B. Any amendments to the building plans and/ar site plan which are not in <br /> conformity with City codes will require further Planning Commission and City <br /> Council review. <br /> 2. Hardcover in the 0— 7S' zone shall be limited to 21.4% or 909 s.f.; and hardcover <br /> 75'- 250' zone shall be limited to 32.3% or 3,367 s.f.; and within the 250'-500' <br /> zone shall be limited to 36.8% or 284 s.f. per the proposed plan and hardcover <br /> allowance summary as depicted on Exhibit A. Applicant is advised that any future <br /> requests to increase hardcover or change the nature of �xisting/approved <br /> hardcover shall require City approval, and increases in hardcover wil� not likely <br /> be approved without concui7ent reduction in existing hardcover. <br /> 3. The applicant has the option to rebuild rather than remodel in accordance with the <br /> plan submitted for review of this variance. <br /> 4. Applicant shall rerr�ove all plastic or fabric liner material from the decot•ative <br /> landscape beds on the property to ensure their pernleability as non-hardcover <br /> surfaces. <br /> 5. Authorities grailted by this resolution run with the property not with the applicant, <br /> but are permissive only and must be exercised by obtaining a building permit for <br /> Pa�e 3 of� <br />
