, I know you have previously requested a survey showing existing and proposed contours on the property. We have not
seen such a drawing but please forward a copy to us if you have one and we will review and comment on the plan as
quickly as we can. In the event the survey has not been prepared, as a compromise, I would be willing to sign off from an
engineering perspective if the work proposed does not go beyond the limits of the proposed patio and fireplace. In other
words if the contractor can certify or guarantee that no grading or grade changes would occur south and west of the
proposed patio and fireplace we could support not requiring the previously requested survey.
As I review the plan on my desk prepared by Outdoor Escapes dated 4-17-10 it appears there is work planned in the SW
corner of the property. It appears the work planned includes the installation of plantings, flagstone and some type of a
water feature. It was my understanding that the only work proposed at this time was the patio and fireplace immediately
adjacent to the SW corner of the house. If the work includes the area in the SW corner of the property I recommend that
you verify that with the applicant and request any further information you may need to permit this work. If the work in the
SW corner of the property is included we will need additional information to understand what grading, if any, is planned
and how this may affect the existing storm sewer catch basin and drainage way from north to south through the rear yard.
In closing I want to be clear, we are not requesting a drainage and utility easement or permission to grade on Mr. Davies
property at this time. We want to do what we can to help expedite the permitting process while ensuring the City has the
necessary documentation to issue the permit.
Please let me know if you need anything else.
Thanks,
Tom
Tom Kellogg, PE
Associate
Direct 651-604-4863
Cell 651-775-5637
tom.kellogg@bonestroo.com
Bonestroo
-----Original Message-----
From: Jeff Davies [mailto:jdavies@wscm.net]
Sent: Tuesday, May 11, 2010 12:36 PM
To: mcurtis@ci.orono.mn.us; ALutz@outdoorexcapes.com; Kellogg, Tom P; Ward, Jared T;
H Frees@outdoorexcapes.com
Cc: kresta.davies@gmail.com
Subject: FW: Following Up
To all,
Firstly, as was discussed last year, Orono has no easement in our yard
and any decision to grade our yard for the purpose that has been
described is purely at our discretion. We were open to hearing ideas
last year and have been accommodating this year despite the fact that
the city and Bonestroo came to us in the 24th hour and seem to be
leveraging our need for work permits to force these discussions, which I
find unethical and simply wrong.
That being said, based on discussions with Jared Ward at Bonestroo, we
are willing to agree to the grading of our yard to allow for emergency
water flow as conceptually framed out. We will allow that to happen
subject to the City of Orono paying for any and all incremental costs
associated with the backyard landscaping project, to include at a
minimum a retaining wall around the stone patio, a retaining wall in the
back end of the property, grading of the yard (including hill), removal
2
