If you wish to have the building permit issued we will <br /> require that you agree to comply with Mr. Kellogg's suggestion (highlighted below) and agree that no work grading be <br /> done outside of the proposed patio and fireplace. This is language we can include on the permit and your contractor will <br /> agree to comply with by signing the permit. <br /> Further in order to comply with City Code Chapter 79, governing construction site runoff control, a $2000 escrow will be <br /> required at the time of the issuance of the permit. I have attached the escrow agreement. This agreement is a <br /> requirement of the issuance of your permit and is between you (the property owner) and the City. The <br /> easement and the landscaping work that they are requesting a permit for are two completely different matters that <br /> seemed to dovetail with each other. It appears Mr. Davies thinks we are trying to leverage the City request for a drainage <br /> and utility easement in exchange for the permit to do the landscaping work. We are not and to make that clear and <br /> hopefully expedite the issuance of the permit to Mr. Davies I would recommend that we withdraw our request for the <br /> drainage and utility easement and permission to grade on Mr. Davies property until some later date. <br /> i <br />
