The Planning Commission finds a new home can be constructed to meet the <br /> required average {akeshore setback. <br /> c. The Property has a unique shape and a large 0-75' area which partialiy <br /> functions as though it is a peninsula. <br /> d. Both adjacent neighbors (at 2691 Carofine Avenue and 2696 Caroline <br /> Avenue) have submitted letters of support for the appfication including the <br /> average fakeshore setback variance as requested. <br /> e. The proposed efevated patio and associated grading will meet the 75-foot <br /> lake setback. <br /> f. The Property will conform ta the hardcover limitations of Tier 1. <br /> g. The Appficants' proposed efevated patio wil� not alter the essential character <br /> of the neighborhood and will result in minimal or no negative impact on <br /> adjacent properties. <br /> h. The Appiicants' proposal to remove the existing above grade deck and move <br /> the outdoor fiving space to the southeast side of the Property wili improve the <br /> potential lake views enjoyed Trom the home at 2691 Caroline Avenue. <br /> i. The existing fake views enjoyed from the property at 2696 Carofine Avenue <br /> will not be adversely impacted by the Appiicants' proposed patio du� to the <br /> elevation difference between the properties and the existing trees on both <br /> properties. <br /> j. The Applicants' request is in harmony with the purpose and intent of the <br /> ordinance. <br /> k. The �ppiicants have aemonstrated that enforcing the provisions of t�e Zoning <br /> Ordinance deprives the Appiicants of the reasonable use of their Property. <br /> l. The Appficants' proposed efevated patio is designed in a way which <br /> minimizes impact of the visual encroachment as opposed to the existing <br /> efevated deck. <br /> m.
