The City Council has considered this application incluciing the findings and <br /> recommendation of the Pianning Commission, reports by City staff, comments by <br /> the Appficants and the public, and the effect of the proposed variance on the <br /> health, safety and welrare of the community. <br /> 5. The City Council finds that the conditions existing on this Property are peculiar to <br /> it and do not apply gene�ally to other property in this zoning district; that granting <br /> the variance would not adversefy affect traffic conditions, fight, air nor pose a fire <br /> hazard or other danger to neighboring property; would not merely serve as a <br /> convenience to the Applicants, but is necessary to alleviate a practical difriculty; <br /> is necessary to preserve a substantial property right of the Applicants; and would <br /> be in keeping with the spirit and intent of the Zoning Code and Comprehensive <br /> Plan of the City. <br /> CONCLUSIOf�S, ORDER AND C�NDITIOhS <br /> Based upon one or more of the above findings, the Orono City Council hereby grants <br /> variances to Orono Municipal Zoning Code Section 78-1279(6) to alfow construcfion of a new <br /> above grade patio ahead of the ave�age lakeshore setback in conjunction with the construction <br /> of a new singfe family residence on the Property, subject to the folfowing conditions: <br /> 1. Council approval is based on the survey submitted by the Applicants and annotated by <br /> City staff, attached to this Resofution as Exhibit B. Any amendments to the site plan <br /> which are not in conformity with City codes will require further Planning Commission and <br /> City Council revi�w. <br /> 2. Proposed hardcover fevels are conforming to the Tier 1 standards and no hardcover <br /> variances are gran'ted. <br /> 3. Authorities granied by this resoluiion run with the property not with the Appiicants, but <br /> are permissive only and must be exercised by obtaining a buiiciing permit for the home <br /> which includes the proposed patio and commencinr� construction of said project. A <br /> Traming inspection must be completed for the home within one year of tne date of <br /> Council approval, or tne variance for the patio will expire on that date (November 25, <br /> 2014). <br /> 4. Violation of or non-compfiance with any of the terms and condiiions of this resoiution <br /> shall constitute a vioiation of the zoning code, shall automaticalty terminate any authority <br /> granted herein, and shall be punishabfe as a misdemeanor. <br /> 5. The undersigned Applicants have read, understand and hereby agree to the terms of <br /> this resolution and on behalf of the Appiicants and the Appficants' heirs, successors and <br /> Page � of 4 <br />
