Zoning , ;.- #991 <br />November, 1985 <br />Page 2 of 2 <br />The engineer, in his review, has requested that the applicant <br />indicate the location of the outlet of the pond near Bohn's Point Road <br />on the Blohorn property since this pond receives the drainage from <br />about half of the Ulrich acreage. Applicant should also be advised <br />that the Cit7 will require a drainage easement to be qranted over the <br />drainaqeways and the pond area. <br />There has also arisen the question of the final gradinq of the <br />berms located on either side of the driveway entrance. These are <br />indicated in the grading plan as "temporary storage" with final qrade <br />undetermined, depending on the need for fill at oti.er locations on the <br />site. Applicant has been requested to move these berms off the right- <br />of-way and is in the process of complying as of this writing. Because <br />these berms are so visually evident along the road, their final <br />grading and appearance is an item for discussion. <br />Staff would suggest that these berms be the subject of a separate <br />conditional use permit application in order to help cover the costs of <br />staff time, especially the engineer's reviews. Applicant should also <br />be made aware that in the event the conditional use permit and <br />variances are aranted for the work at the lakeshore, that there is an <br />actual lakeshore grading permit fee required in the amount of $400 <br />($2U0 fee, $200 after -the -fact investigation fee) in addition to the <br />$400 conditional use permit application fee already paid. Note that <br />the above application and permit fees are required because the current <br />work does exceed the "normal and customary grading in the area of a <br />newly constructed bui ldinq" per Section 10.03, Subdivision 21. <br />Any motion for recommendinq approval should address these items: <br />1. maintain adequate shoreline protection until lakeshore area <br />is fully vegetate(] <br />2. notify applicant that no hardcover or structure is allowed in <br />the 0-75' setback area <br />3. notify applicant. that the araIinq outside the 0-75' is also <br />subject to conditional use permit review, and that the City <br />engineer has requested additional information on the pond outlet <br />and discharge, that drainage easements will be necessary, and <br />that. the roadside berg: configuration is subject to review. <br />
