He has also acquired the Biohorn <br />residence to the south and is anticipating a lot line rearrangement <br />between the two properties which will increase applicants lot to <br />nearly 5 acres and leave the former Blohorn property with about 2 <br />acres. (That is the subject of a future application.) <br />Mr. Ulrich was qranted a building permit to construct a new home <br />at 1539 Bohn's Point Road. Grading plans had been submitted for that <br />property and sere considered as normal and customar•; for the residence <br />in question. Note that applicant had been per teal to fill portions <br />of the property in the years prior to construe. jn it anticipation of <br />the project. <br />on October 21, 1985, staff became aware that gradinq was occurinq <br />in the 0-75' lakeshore setback area. Staff subsequently visited the <br />site, noted the work that had been done, and discussed with the owner <br />the immediate protection measures necessary and the application pro- <br />cess for an after -the -fact conditional use permit. Applicant was told <br />►-y staff that he should finish -grade the area and seed it as soon as <br />possible. This was completed as of 11/8/85 and at that time staff <br />requested further shoreline protection measures including additions: <br />hay hales and silt fence, which has also now been installed. <br />Staff review of the site and grading plan indicates that the <br />major changes in contour occurred outside the 0-75' area. There would <br />appear to be some minor fillinq and smoothinq of the :anti surroundinq <br />the lagoon; however, this leaves a fairly flat slope and slowed run- <br />off within 50' of the lagoon and the lakeshore, conRis.ent with what <br />previously existed but a more uniform appearance. <br />
