Jack Rhode - 1110 Pohns Point Road <br />Variance ` <br />.3 <br />Pa-e <br />STAFF - August 17, 1977 <br />Enclosed is a copy of the walkway easement for Hannah and Stewart properties. ()ur <br />ordinance does not address itself to setbacks from easements. <br />The dock issue was considered by the Planning Commission at a previous meeting and <br />although no determination was made, it was suggested that approval might be given <br />for one dick with three slips - including the two easement owners and the property <br />owner himself. <br />C'XNCIL NUTING • August 22, 1977 <br />'!r. Rhode, his attorney, `Ir. & %Irs. Becker and attorney, and the Laurer's son were <br />present. Lonf,. discussion followed. <br />The Decker's maintained that the variance application made in 1974 was misrepresented <br />because City records indicated the area of the subject lot to be .91 of an acre. <br />The zoning administrator searched through the file, but could not find this. However, <br />he uAd find the original application which noted the prope:-ty to be less than an acre <br />and Mr. Schiller's report which stated that the lot contained about 24,000 sq. ft. <br />!Vote: The morning of August 23, 1977, Mrs. Hecker met with me. I tried <br />again to locate this data -- again without success. She later informed <br />me that Steve Hanlin of the Assessor's office had once disclosed the tax <br />records which indicate the parcel to he .91 of an acre. 1 checked the <br />tax records and found same. I explained to her that often times the <br />areas of parcels are miscalculated at the County Tax department through <br />use of the nlanimeter. .After obtaining approval from 'Ir. Bonson, 'Irs. <br />Becker nicked up copies of some of the documentation from the original <br />application filed in 1974. <br />Me Council, on City Attorney's recommendation, instructed the attomvs of both clients <br />to suhmit their arguments in %Titing by August M, 1977, to give each a chance `or <br />rebuttal by `'aeptemhcr 2.
