In a previous platting of the subject property, the <br />applicants created covenants for the maintenance of a future <br />private road providing for the shared use of said road by certain <br />properties to the immediate east of the road outlot at a cost of <br />$8,000.00 plus "carrying charges" per each 2 acre lot. <br />NOW, THEREFORE BE IT RESOLVED, that based upon either one or <br />more of the findings noted above, the City Council of the City of <br />Orono hereby approves the preliminary plat application of John Vogt <br />and Michael J. Hilbelink that would propose the further division of <br />Lots 2 and 3, Block 1, Peterman Addition per plat drawings by Phillip <br />A. Nelson dated November 19, 1986, and further grants a variance to <br />the standard that would require all lots have frontage on a public <br />road with the creation of a private road and per Section 6.05 of the <br />Municipal Code, the City grants a permit to construct drainage ditches <br />and install culverts within the public right-of-way, subject to the <br />following conditions: <br />i. Prior to the issuance of building permits for new <br />construction, the final plat must be filed with the Hennepin <br />County Recorder's office, road base installed and approved by <br />City, and, if required improvements are not completed, the <br />developers must execute a developer's agreement and post a letter <br />of credit (150% of cost of remaining improvements). <br />The following list of final submittals must be submitted to the <br />Zoning Administrator two weeks prior to the regularl- scheduled <br />Council meeting on the second and fourth Mondays of the m the <br />Required Improvements <br />a) Drainage ditches (2 foot depth) to be installed ■long the <br />west lot lines of Lots 1 and 2 and from the intersection of the <br />private road at Watertown Road along the north side of the <br />Watertown Road right-of-way to the Rosch's driveway. Existing <br />culvert under Roach driveway to be resised and replaced. <br />Drainage plans must be approved by the City prior to the <br />installation of ditches and culverts. <br />b) Private road to be constructed per standards setforth in <br />Section 11.33, Subdivision 4 and 5 for road serving 3-6 lots. <br />Engineering plans must be approved by City prior to any <br />construction. <br />Page 2 of 4 <br />
