7 <br />TO: Council <br />FROM: Alan P. Olson, City Planner <br />DATE: October 26, 1979 <br />SUBJECT: 1508 Paul A. Scherber, 1420 Hohns Point, Road <br />PRELIMINARY SUBDIVISION <br />The Planner's review adds the following comments: <br />1. The park fee should not be char(jed as there is an existing <br />dwelling on bc)t.h lots. <br />2. Each lot han—,arat&, actually existing access. Any <br />mutual easement for reciprocal. use should be a private <br />matter of no concern to the City. <br />3. Mr. Lauer's concern for the easement across the north <br />part of the property is natural. The easement is developed <br />as a gravel drive and though poorly maintained, is a <br />secondary access to the Lauer property. I would suggest <br />requiring this easement to be platted as an outlot so the <br />access will be visible on the plat and will be lass likely <br />to be encroached upon in the future. The City could ignores <br />the easement and assume that it, will carry through with <br />validity, but the outlot method will assure the intent of the <br />easement in providing access to the otherwise land -locked <br />Lauer lot. <br />4. The encroaching shed is of minimal value and easily moved anti/or <br />removed. <br />5. The mr.:st serious question was apparently not disc sried by the <br />Planning Commission. The neighboring house at 14d0 Hohns Point <br />is shown as encroaching on this property. We have a survey on <br />file showing a 50 ft. setback for the original construction <br />in 1962, plus other permits for a 24 x 24 addition and <br />conversions without surveys, but nothing to indicate such an <br />encroachment. <br />The Scherbe*r's surveyor should recheck and confirm or clrir- <br />up any encroachment. <br />If there is encroachment, I suggest that at least 10 feet of <br />side ,Ard be platted and sold to the neighbor to resolv, this <br />problem. Such a sale would not adversely affect this property. <br />6. Bohns Paint Road should be platted and dedicated 33 feet from <br />center 1 i:ta . <br />
