This application was last <br />reviewed by the City Council on June 12, 1999. The application was tabled at that time due to an issue <br />relating to the location of one of the cabins only 1.5' from the new proposed prope1ty line. At issue was the <br />State of Minnesota Building Code requirement that buildings with openings (such as windows and doorways) <br />can not be located closer than 3' to a propet1y line. Fmther, all walls exposed to the property line are also <br />required to be fire resistant. The purpose is to eliminate the potential for fires from spreading from one <br />prope1ty to another. <br />The prope1ty owners had suggested they enter into an agreement with the City of Orono that they would <br />agree to remove the cabin within 30 months from the approval of the lot line rearrangement. The City chose <br />not to enter into the agreement because of the difficultly the City may have with requiring the cabin to be <br />removed if it were still on the property after the 30 month time period expires. Rather than entering into an <br />agreement the City and applicant had placed the approval on hold until some time after the cabin was <br />removed. <br />The prope1ty owners have notified the City that the cabin has recently been removed and they wish to <br />complete the lot line rearrangement.
