Johnson <br />March 28, 2002 <br />Pa e 2 of2 <br />Big Island Lot Designations <br />The proposed subdivision/combination process results in the need to amend Big Island Record Lot numbers <br />as they were designated in Section 10.31 of the Zoning Code in 1984. Per Exhibit C, the Bryson parcel will <br />incorporate Record Lots 66, 59 and½ of 44. The Johnson parcel will include½ of Record Lot 44 plus the <br />4 parcels that comprise Record Lot 31. Staff will be presenting a comprehensive update of Section 10.31 <br />(the RS District/Big Island) later this year to make all the changes to it since 1984. <br />Staff Recommendation <br />Staff recommends approval of the lot line rearrangement to create two residential lots from the four existing <br />propet1ies subject to the following conditions: <br />1. Prior to filing the new propet1y descriptions, an inspection of the 660 Big Island property is <br />completed to ensure all existing structures and the stairway is removed. <br />2. The easement that was required for a shared septic system is shall be eliminated since it no longer <br />is required. Based on the new property line location, the drainfield and tanks would now be located <br />on the same property as the cabin they serve. <br />3. Propet1y owners shall have their surveyor provide legal descriptions for drainage and utility <br />easements 5' along the interior prope11y line and 1 O' on exterior propet1y lines. <br />4. A title opinion shall be completed and provided to the City of Orono, prior to filing the new property <br />descriptions. <br />5. Property owners shall be advised that the minimum lot size for subdivision on Big Island is 5 acres. <br />The 5 acre minimum lot size would prohibit any future subdivision of the lots. <br />Planning Commission Recommendation <br />The Planning Commission reviewed the lot line rearrangement on March I 5, 1999 and recommended <br />approval by a vote of 5 to 0. The proposed lot layout has not changed from the plan reviewed by the <br />Planning Commission. A copy of March 15 th minutes are attached. <br />COUNCIL ACTION REQUESTED <br />To adopt the attached resolution approving the lot line rearrangement for Johnson/Bryson to create two <br />residential lots from the 4 existing propet1ies.
