13. The proposed lot lines require a variance to the required 150' <br />setbacks for an animal barn. The eo isting barn on Lot 1 will be 70' <br />from the property line of Lot 2 to the . _;t. Hardships for granting <br />of this variance include location of the existing fence lines east of <br />the animal barn, and the fact that the barn is only 130' from the pre- <br />existing east property boundary such that the 150' setback was not met <br />under existing lot lines. <br />NOW THEREFORE DR IT RESOLVED, that based upon either one or more <br />of the findings noted above, the City Council of the City of Orono hereby <br />&proves the preliminary plat for Robert and Carol Trapp at 4701 West Branch <br />Road per the preliminary plat drawings by Gary L. Gabriel dated February 6, <br />1980 and as shown on the proposed final plat drawings by Gary Gabriel <br />(undated) subject to the following conditions: <br />1. Lots 1 and 2 shall share a single driveway access located over the <br />existing driveway. <br />2. A Conservation and Flowage Easement shall be granted over the <br />designated wetlands on the property. <br />3. Roadway to be dedicated on the plat shall include 40' for right- <br />of-way for West Branch Road and 3C' along the southern boundary of the <br />property for future development of Highview Lane. <br />4. A road and utilities easement shall be granted over the portion of <br />Lot 2 that is 25' wide. <br />5. At such time that Highview Lane becomes a developed City road, Lot <br />2 will be required to gain access from Highview Lane. <br />The following list of final submittals must be submitted to the <br />Zoning Administrator two weeks prior to the regularly scheduled Council <br />greeting on the second and fourth Mondays of the month: <br />A. RECORD PLAT DRAWINGS in the form of two (2) mylar copies (3 <br />mylars if torrens property) and one (1) additional copy reduced to 1"R2001. <br />Drawing to include: <br />1 ) Lot lines platted per preliminary plat drawings by Gary L. <br />Gabriel dated February 6, 1980 and as shown on the proposed <br />final plat drawings by Gary Gabriel (undated). <br />2) Dedication of "drainage and utility easements" 10' wide <br />along all perimeter property lines and 5' each side of internal <br />property line as shown on the aforementioned proposed final plat <br />drawing. <br />Page 3 of 5 <br />
