1886.1 <br />TO: Mayer and City Council � <br />FROM: Mark Btrnhardson, City AdministratOP C) <br />DATE: January 8, 1986 <br />SUBJECT: i,MCD Residential Dock Boat Allowance <br />As you may be aware the LMCD has had a second reading on the <br />ordinance that was discussed at our December 9th Council meeting <br />relating to limitations on the boats. The Council instructed <br />Orono's L.MCD representative to vote against the second reading of <br />the ordinance which she did. It is her desire to come forward to <br />discuss the issue with you. <br />In attempting to understand the new ordinance and within my <br />understanding of the new ordinance, the following are permitted: <br />A. If lakeshore 176 feet or over, up to 4 boats* are <br />allowed, rental is not an issue and it can be 4 <br />different owners none of whom are the riparian owner. <br />B. If 126 - 1.75 feet 3 boats are permitted, rental is <br />not an issue and the 3 owners can be different than the <br />riparian owner. <br />C. Up to 125 feet of lakeshore <br />- 2 boats - could be rented to 2 different owners <br />neither of which is riparian owner. <br />- 3 or 4 boats •- owner must prove ownership of all <br />boats registered to the resident and have a permit <br />for such. <br />+). "Slips" for any number of boats not qualifying as <br />"water craft: could be used/rented and be in <br />compliance with the ordinance. <br />In conjunction with this a review of Orono's ordinance (which <br />apart from LMCn does not put a limitation on the number of boats <br />as the function of lakeshore frontage) would permit any of the <br />following combinations for boats at a dock. <br />- 1 to 2 owners - this is legal under Orono's ordinance <br />and would require no additional permits even if the <br />slips wero rented to persons other than the riparian <br />owner. <br />3 or more owners - this would require a joint use dock <br />permit from the City of Orono whether or not they <br />are renters. <br />- Lf more than 3 of the apots are rented this would <br />qualify as a husiness use an ther fore would be <br />
