nrohihited under Orono's zoning ordinance a.3 not an <br />authorized use in a residential zone. <br />—his understanding is arrived at by combining our current marina <br />Joint use dock ordinances with oar zoning ordinance. The zoning <br />ordinance does not specifically address it, but since the marina <br />does discuss what qualifies as a business use under that <br />ordinance it would most probably establish the threshold for <br />declaring a business use in a residential zone. The enforcement <br />by the City staff however up to this point has been different <br />with the City staff interpretation being that any time there has <br />I <br />e 2n a rental, that it's business use and it is not allowed. <br />ISSUES - As identified by the Council last time the issues that <br />are problematic in the proposed LMCD ordinance are as follows: <br />- The need to furnish proof of ownership and a <br />permit fee paid for people who are docking their own <br />boats. <br />- That this permit must be approved by the LMCD <br />Executive Director. <br />'ldditional ly as an issue there seems to be some disparity as to <br />who can or can not rent based on lakeshore size and the fact that <br />it the person with up to 125 feet desires to have more than 2 <br />boats at his oL her dock, then all the boats must be registered <br />to that person where as someone over 176 feet can rent up to four <br />slips. <br />RECOMMT.NDAT I ON <br />To address some of these issues and to perhaps strengthen what is <br />apparently the intent of LMCD it is recommended that the <br />following ideas be explored for incorporation in an LMCD <br />ordinance: <br />- Require that all watercraft that are at a dock be <br />currently registered with either the state or <br />appropriate federal numbers and registration. This <br />would also apply to any boats being used on Lake <br />Minnetonka. (This would not apply at marinas, but <br />would apply to any boats from the marinas used on <br />the lake outside the marina.) <br />- That differentiations for the number of boats at the <br />docks he addressed on 3 issues <br />- numher per front footage <br />- number of owners <br />- rental <br />- it is suggest^d that at a minimum any 2 boats must be <br />regist.erel to the: owner and if the intent is to get at a <br />ronta I requ i re that i 1 1 �x»ts at the dock b- lung to the <br />
