Johnson (hereinaftc: "the <br />applicant") .is the owner of the property located at 365 North Old <br />Crystal Bay Road within the City of Orono (hereinafter "City") <br />and legally described as foliows: <br />The West half of the North 10 acres of that part of the East <br />half of the Southwest quarter of Section 33, Township 118 <br />North, Range 23 West of the 5th principal meridian, lying <br />South of the right-of-way of the Great Northern Railway, <br />according to the U.S. Government Survey thereof, including <br />an easement over the North 20 feet of the East half of the <br />North 10 acres of that part of the East half of the South- <br />west quarter of Section 33, Township 118 North, Range 23 <br />West of the 5th principal meridian, lying South of the <br />ight-of-way of the Great. Northern Railway; (hereinafter <br />"property"); and <br />WHEREAS, the applicant has applied to the City for a <br />variance to Municipal 'boning Code Section 10.03, Subdivision 9 to <br />pert;;it the construction of a 1,620 s.f. storage building where <br />accessory structures exceeding 1,000 s.f. in area are not <br />normal l y al lowed. <br />NOW, THEREFORE, BF. IT RESOLVED by the City Council of <br />Orono, Minnesota: <br />FINDING'S <br />1. This application was revi.rwerl as Zoning Fi?e #95 <br />2. The property is to-Latei in the RR-18 Singie Family Rural <br />Residential Zoning District. <br />3. The urono Planning Cummission reviewed this application <br />on October 21, 1985, and recommended approval of the pro- <br />posed variance based upon the following findings: <br />A) The structure is not intended to house animals and <br />therefore meets the required setbacks for a storage <br />structure. <br />Page 1 of 4 <br />
