The City Council finds that the conditions %_ ,Ring on <br />this property are peculiar to it and do not apply gei,erally <br />to other property in this zoning district; that arantinq the <br />variance would not adversely affect traffic conditions, <br />light, air nor pose a fire hazard or other danger to neigh- <br />boring property; wou'd not merely se-ve as a convenience to <br />the applicant, bu* s necessary to a, leviat.e a demonstrable <br />hardship or dif1_,:u, ty; is necessary to preserve a sub- <br />stantial property right of the appl-*.cant; and would be in <br />keeping with the spirit:. an(i intent of the Zoning Code and <br />Ccmprehensive Plan of the City. <br />CONCLUSIONS, ORDER AND CONDITIONS <br />Based upon the above finding, the Orono City Council <br />hereby chants a variance to the Municipal Zoning Code Section <br />.0.03, Subdivision. 9 to permit the construction of a 1,620 s.f. <br />storage building where accessory structures exceeding 1,000 s.f. <br />in area are not norinally allowed, sublect to the followinq <br />,�-)nditions: <br />1. This building may not be used as a stable or to house <br />animals, because it is less than 150' from the north lot. <br />line. Use for animal housing would require a variance. <br />4. Authorities grante• '-v this variance run with the <br />property, not with the ap, int, but are permissive only and <br />must be exercised by apr_ication for a building permit <br />within one year of the date of Council approval, or this <br />variance will expire on that date (October 28, 11,86). <br />5.
