Box 66 <br />Crystal Bay, MN 55323 <br />Dear Mr. Gerhardson: <br />Our office represents Mr. Merlin Halverson, 41.75 Highwood Road. We <br />request that the City Council consider the following facts and take <br />one of the steps described below at its next meeting on October 28, <br />1985. <br />An unimproved alley abuts Mr. Halverson's property. A certificate <br />of survey attached to this letter shows the location of the alley in <br />reference to Mr. Halverson's lot number 24. 'lfiis alley was dedicated <br />to the public when the property was platted in 1909. Apparently, the <br />original purpose of the alley was use as a fire lane. Whether it was <br />ever used for this purpose is unknown, but it is clear that it has not <br />been ust- is such for many years, and that it will not be used for that <br />purpose i,, the future. The alley serves no other important public <br />purpose either. It is located off a quiet, dead-end residential street. <br />From the street it is not recognizable as an alley. It is overgrown <br />with trees, bushes and tall grasses. The City has made no effort to <br />maintain it in the past and has no intention of maintaining it in the <br />future. At the present, it is impassable by any four-wheel vehicles. <br />If it were improved, it would still be too narrow for launching boats <br />or for use as a swimming beach. In short, it serves no public purpose. <br />reover, it has been used very little by the public. Tire presence of <br />ti.ick vegetation and the absence of any foot path is proof that the <br />alley is not used by the general public. Its presence, however, has at <br />times attracted late night party goers who have caused problems for <br />Mr. Halverson. They have come of snowmobiles, on motor bikes, and by <br />foot. They have been very noisy late at night. They have littered the <br />area with beer cans and bottles. They have trespassed upon Mr. Halverson's <br />property, vandalizing his property and harassing him. Mr. Halverson's <br />house is situated approximately thirty (30) feet from the alley.
