3 City of ORC NO <br />RESOLUTION OF THE CITY COUNCIL <br />A RESOLUTION GRANTING <br />A VARIANCE TO <br />MUNICIPAL ZONING CODE <br />SECTION 10.03, SUBDIVISION 13 <br />AND SECTION 10.03, SUBDIVISION 15 (F) <br />FILE #971 <br />WHEREAS, Mark S. Wasserman (hereinafter "the <br />applicant") is the owner of the property located at 1045 Linden <br />Lane within the City of Orono (hereinafter "City") and legally <br />described as follows: <br />(per Exhibit "A" attached) (hereinafter "property"); and <br />WHEREAS, the applicant has applied to the City for a <br />variance tC Municipal Zoning Code Sections 10.03, Subdivision 11 <br />and 10.0.1, Subdivision 15 (F) to permit the construction cf a ne:•, <br />foundation under an existing non -conforming garage which is <br />located 5.6 feet from the side iot line where a 10 foot setback <br />is normally required and which is located 12 feet from the front <br />(or street) i ,t line where 3 35 foot setback is normally re- <br />qui red. <br />NOW, THEREFORE, BE IT RESOLVED by the City Council of <br />Orono, Minnesota: <br />FINDINGS <br />1. This application was reviewed as Zoning File #971. <br />2. The property is located in the LR-1B Single Fami ly <br />Lakeshore Residential Zoning District. <br />3. The Orono Planning Commission reviewed this application <br />on October 21, 1985, and recommended approval of the pro- <br />posed variances based upon the following findings: <br />A) The existing garage has a failing foundation which <br />may become hazardous if not repaired or replaced. <br />B) Placement of the garage to meet. the 35 foot street <br />setback would require a very steep and potentially <br />unsafe driveway due to the eievatic of the road above <br />the property. <br />C) Placement of the garage to the south in or3er to <br />meet the 10' side setback would Pncroach into the <br />limited driveway leading to parking area downhill from <br />the garage. <br />Page 1 of 4 <br />
