City, of ORONO <br />RESOLUTION OF THE CITY COUNCIL <br />D) Linden Lane is a (lead end street and is not likely <br />to become a through street based on the fully developed <br />surrounding properties. <br />E) Although the garage doors face the street, there is <br />room to park cars in front of the garage without <br />affecting traffic on Linden Lane. <br />4. The City Council has considered tt..s application <br />including the findings and recommendations of the Planning <br />Commission, reports by City staff, commer:ts by the applicant <br />and the effect of the proposed variance on the health, <br />safety and welfare of the community. <br />5. The City Council finds that the conditions existing on <br />this property are peculiar to it and do not apply gereially <br />to other property in this zoning di--t-ict; that granting the <br />variance would not adversely af` `raffic conditions, <br />light, air nor pose a fire haz, or otter danger to <br />neighbor--_ng property; would not merely s( ~ve as a <br />convenience to the applicant, but is necessary to alleviate <br />a demonstrable hardship or difficulty; is necessary to pre- <br />serve a substanvial property right. of the applicant; and <br />would be in keeping with the spirit and intent -)f the Zoning <br />Code and Comprehensive Plan of the City. <br />CONCLUSIONS, ORDER AND CONDITIONS <br />Based upon the above findings, the Orono City Council <br />1 .y grants a variance to the Municipal Zoning Corse Sections <br />1G.,.3, Subdivision 13 and 10.03, Subdivision 15 (F) to permit the <br />construction of a new foundation under an existing non-confor--'-- <br />gar- 3e located 12 feet from t;ie street lot line where e <br />set ick is normally required and located 5.6 feet from a Eid• <br />line where a 1.0 foot side setback is normally required, sub; <br />to the following conditions: <br />1. Applicant is advised chat the garage has keen and will <br />-ontinue to be considered as a non -conforming structure and <br />is > `,ject to the pertinent ordinances governing such <br />stru .res. <br />2. Authorities granted by this variance run with the <br />property not with the applicant, t-,ut are permissive only anti <br />must be exercised by application for 3 building permit <br />within one year of the date of Council approval, or this <br />variance will. expire on that date (October 28, 1986). <br />Rage 2 of 4 <br />
