PAGE 16 <br />#932 WARD EDWARDS <br />2474 CARMAN STREET <br />VARIANCE <br />PUBLIC HEARING 10:44-10:55 PM <br />Chairman Callahan called for the public hearing at 10:44 p.m. <br />concerning the Edward's variance application. Assistant <br />Zoning Administrator Gaffron noted the certificate of <br />mailing and the affidavit of publication. Ward Edwards was <br />present. There was no one present from the audience for this <br />public hearing. <br />Assistant Zoning Administrator Gaffron noted that the <br />applicant is requesting lakeshore setback and hardcover <br />variances to locate his new home 50' from the lakeshore. <br />Gaffron explained that this lot is subjected to two 75' <br />lakeshore setbacks. Gaffron noted that the existing homes <br />are located an average of 50' from the lakeshore. Gaffron <br />noted that both neighbors have noted that they value the view <br />of the lagoon. <br />Rovegno noted that either way the proposed home is moved it <br />gets closer to the lake and is subject to two 75' setback lines <br />on both sides. <br />Assistant Zoning Administrator Gaffron noted that it is an <br />existing lot of record and asked the Planning Commission if <br />they would recommend crediting areas across the lagoon <br />permanently in order to meet the lot area requirement. <br />Kelley felt that there were enough hardships on the property <br />that the applicant doesn't need the credit. <br />Rovegno noted that the applicant would still need a lot area <br />variance even with the credit. <br />Chairman Callahan closed the public hearing at 10:55 p.m. <br />Callahan pointed out in order to keep the development down to <br />the north, he would be inclined to require the credit. <br />Kelley moved, Goetten seconded, to recommend approval of the <br />a lot area variance for Ward Edwards based on the following <br />findings: <br />1. The lot width of 125' is greater than 80% of the required <br />140' width, so no formal lot width variance is required. <br />2. The drainage from the house should all be directed toward <br />the lagoon in order to gain the maximum infiltration time <br />and distance. <br />3. Based on item 2 above, the hardcover in the lagoon 75- <br />190' zone is requested to be 4,940 sf or 34.4%, <br />requesting a 9.4% variance for a new home. <br />
