PAGE 15 <br />9930 SHAVER Chairman Callahan moved, Kelley seconded, to recommend <br />(Cont.) approval of the rear setback variance for Jim Shaver based on <br />the following findings and hardships: <br />1. The dry buildable area is less than a 1/2 acre, but <br />subject to two acre setback standards. <br />2. The majority of the lot is a 2 1/2 acre wetlands that <br />serves as a retention area fnr surrounding neighborhood. <br />3. Sewer is available to the property. <br />4. The proposed house is consistent with older developed <br />lots on north side of road where majority of lots also <br />have extensive wetlands and restricted building <br />envelopes. <br />5. An error was made in the original resolution approving <br />sewer for this site and informing the applicant that no <br />variance would be needed for a proposed house on subject <br />lot. <br />6. Variance will not cause most affected owner any problems <br />and most affected owner has been shown the proposal. <br />Motion, Ayes (7), Nays (0). <br />#931 J. F. FLEISCHHACKER <br />2775 SHADYWOOD ROAD <br />CONDITIONAL USE PERMIT <br />PUBLIC BEARING 10:40-10:55 PM <br />Chairman Callahan called for the public hearing at 10:40 p.m. <br />concerning the proposed conditional use permit application <br />of J. F. Fleischhacker. Zoning Administrator Mabusth noted <br />the certificate of mailing and the affidavit of publication. <br />There was no one present from the audience for this public <br />hearing. <br />Zoning Administrator Mabusth explained that the appli. <br />requests conditional use permit to remove approximatell <br />cubic yards of fill along the edge of 70 feet of shoreline <br />place fresh sand along shore if needed. Mabusth noted that <br />the shoreline is eroding away and this proposal will help the <br />situation. <br />Chairman Callahan closed the public hearing at 10:55 p.m. <br />McDonald moved, Taylor seconded, to recommend approval of <br />the conditional use permit application for J. F. <br />Fleischhacker finding the project to be in keeping with the <br />intent of the standards for shoreline use as set forth in the <br />Community Management Plan. Motion, Ayes (7), Nays (0). <br />
