Contractor . . � ,tee of per formance of the change in work in one or more of <br />the following ways: <br />11.1.1 By mutual acceptance of a lump sum proper'.v itemized, <br />11.3.2 By unit prices stated in the Contract Documents or subsequently agreed <br />upon (unit prices shall include an allowance for Contractor's main office ex- <br />pense, overhead, profit and bond), or <br />11.3.3 By actual cost of the changed work, plus an allowancf! for overhead, <br />supervision and profit, as defined as follows: <br />1. The "cost of the changed work" shall mean costs necessarily incurred <br />in the proper performance of the changed work and paid by Contractor at rates <br />not higher than the standard paid in the locality of the work (except with <br />prior consent of the owner) as more specifically defined as follows: <br />a. The cost of t!:• changed work shall include: <br />(1) Wages paid for labor in the direct employ of Contractor in the <br />performance of the changed work in the field or in the fabrication <br />shop under applicable collective bargaining agreements or under a <br />salary or wage schedule agreed upon by Contractor and owner, plus a <br />payroll markup of 40 percent to cover all overhead items applicable to <br />payroll, such as insurance, taxes, F.I.C.A., workmen's compensation, <br />unemployment taxes, and union benefits. <br />(2` Cost of all materials, supplies and equipment incorporated in the <br />changed work. <br />(3) Cost, including maintenance of all materials, supplies, equip- <br />ment, temporary facilities and hand tools owned by workmen, which are <br />consumed in the performance of the changed work, and cost less salvage <br />value on such items used but not conaum•3 which remain the property of <br />the Contractor. <br />(4) Rental charges of all necessary machinery and equipment, exclu- <br />sive of hand tools, used in performing the changed work, including <br />installation, minor repairs and replacements, dismantling, removal, <br />transportation and delivery costs thereof at rental charges consistent <br />with those prevailing in the area. <br />(5) Cost of additional premiums for all bonds and insurance which the <br />Contractor is required by the owner or contract documents to purchase <br />and maintain And which is incurred as a result of performing the <br />changed work. <br />(6) Sales, use or similar taxes, related to the changed work and for <br />which the Contractor is liable, imposed by any governmental authority. <br />(7) Permit fees, roy..lties, damages for infringment of patents and <br />costs of defending suits therefore, and deposits lost for causes other <br />`han the Contractor's negligence. <br />4? _ <br />l /85 - 8507b <br />Copyright 1995 <br />1lonestroo, Rosenr, AvdQrlik <br />i Associates, Inc. <br />
