evaluate the Work for compliance with the Contract Documents. The use of any <br />such term or adjective never indicates that Engineer shall have authority to <br />supervise or direct performance of the Work or authority to undertake respon- <br />sibility contrary to the provisions of Paragraphs 7.1.9 or 7.1.10. <br />7.1.9 Engineer will not be responsible for Contractor's means, methods, tech- <br />niques, sequences or procedures of construction, or the safety precautions and <br />programs incident thereto, and Engineer will not be responsible for contrac- <br />tor's failure to perform the Work in accordance with the Contract Documents. <br />7.1.10 Engineer will not be responsible for the acts or omissions of Contrac- <br />tor or of any Subcontractors, or of the agents or employees of any Contractor <br />or Subcontractor, or of any other persons at the site of otherwise performing <br />any of the Work. <br />7.2. CONTRACTOR'S RF.SPONSIHILTTIES <br />7.2.1. The Contractor shall supervise and direct the work competently and <br />efficiently, devoting such attention thereto and applying such skills and <br />expertise as may be necessary to perform the work in accordance with the Con- <br />tract Documents. The Contractor shall be solely responsible for the means, <br />methods, techniques, quality of workmanship, sequences and procedures of con- <br />struction. The Contractor shall be responsible to see that the finished work <br />complies accurately with the Contract Documenta. <br />A competent superintendent, who is acceptable to the Owner, shall be main- <br />tained on the Work site and give efficient supervision to the Work until its <br />completion. The superintendent shall have full authority to act on behalf of <br />the Contractor, and all communications given to the superintendent shall be as <br />binding as if given to the Contractor. It shall be the responsibility of the <br />Contractor's superintendent to coordinate the work of all the Subcontractors. <br />When required, the superintendent shall be present on the site to perform <br />adequate supervision and coordination. <br />Contractor shall provide competent, suitably qualified personnel to survey and <br />lay out the Work and perform construction as required by the Contract Docu- <br />ments. Contractor shall at all times maintain good discipline and order at <br />the site. ' <br />The Contractor shall at all times be i,onsible for the conduct and discip- <br />line of his employees and/or any Subcc. :-actors. All workmen must have suf- <br />ficient knowled`e, skill and experience to perform properly the work assigned <br />to them. Any foreman and workman employed by the Contractor or Subcontractor <br />who does not perform his work in a skillful manner, or appears to be incompe- <br />tent or to act in a disorderly or intemperate manner shall be removed immed- <br />iately and sha:l not be employed again in any portion of the Work. <br />7.2.2.
