r <br />rduties of the Resident Project Representative may consist of, but shall not be <br />limited to, the following: <br />C 1. General contract administration <br />2. Periodic observation of the Work <br />3. Unit price quantity and record plan measurements <br />4. Schedule, perform and verify tests and inspections <br />5. Monitor Contractor's progress performance <br />r, 6. Provide information for the Engineer's review <br />and decision concerning disputes and defective Work. <br />7.1.4 Engineer will issue with reasonable promptness such written clarifica- <br />tions or interpretations of the Contract Documents (in the form of Drawings or <br />otherwise) as Engineer may determine necessary, which shall be consistent with <br />or reasonably inferable from the overall intent of the Contract Documents. If <br />Contractor believes that a written clarification or interpretation justifies <br />an increase in the Contract Price or Contract Time, Contractor may make a <br />claim therefor as provided in Section 10 or Section 11. <br />7.1.5 Engineer will have authority to disapprove or reject Work which is <br />defective, and will also have authority to require special inspection or test- <br />ing of the Work as provided in Paragraph 8.10, whether or not the Work is <br />fabricated, installed or completed. The Engineer shall not have charge of or <br />control over the Work and shall have no authority to stop the Work. <br />7.1.6 Neither Engineer's authority to act under this Section 7 or elsewhere <br />in the Contract Documents nor any decision made by Engineer in good faith <br />either to exercise or not exercise such authority shall give rise to any duty <br />or responsibility of Engineer to Contractor, any Subcontractor, any manufac- <br />turer, fabricator, supplier or distributor, or any of their gents or employ- <br />a ees or any other person performing any of the Work. <br />7.1.7 If a Resident Project Representative is assigned to the project, the <br />purpose of his efforts shall be to provide a greater degree of assurance to <br />the Owner that the Work is constructed in conformance to the requirements of <br />the Contract. The Resident Project Representative's efforts are for the bene- <br />fit of the Owner alone. Neither his authority to act nor his decision to <br />exercise or not exercise such authority shall give rise to any duty or respon- <br />sibility to the Contractor, any subcontractor, any manufacturer, fabricator, <br />supplier or distributor, or any of their agents or employees or any other per- <br />son performing any of the Work. The Resident Project Representatives author- <br />ity shall not exceed limitations on Engineer's authority as set forth in the <br />Contract Documents nor shall the Resident Project Representative undertake any <br />of the responsibilities of Contractor, Subcontractors, or Contractor's Super- <br />intendent. <br />7.1.8 Whenever in the Contract Documents the terms "as ordered", "as direc- <br />ted", "as required", "as allowed", or terms of like effect or import are used, <br />or the adjectives "reasonable", "suitable", "acceptable", "proper", or "satis- <br />factory", or adjectives of like effect or import are used to describe require- <br />,r-nts, direction, review or judgment of Engineer as to the Work, it is in - <br />ended that such requirements, direction, review or judgment will be solely to <br />- 1Q - <br />1/R5 - 8505b <br />Copyright 1985 <br />Bonestroo, Rosene, Anderlik <br />6 Associates, Inc. <br />
