i� <br />shall be Available to Engineer for examination and shall he delivered to Engi- <br />neer for Owner upon completion of the Work. <br />4.6 OWNERSHIP OF DRAWINGS AND SPECIFICATION AND REUSE <br />All original Drawings and Specifications and other data furnished by the Engi- <br />neer are and shall remain his property. Copies thereof w-ll be furnished to <br />Owner and are to be used onl1i with respect to this Project and are not to be <br />used on any other project or extensions of this Project without the prior <br />written consent of Engineer. Submission or distribution to meet official <br />regulatory requirements or for other purposes in connection with the Project <br />are not to be construed as publication in derogation of the Engineer's common <br />law copyright or other reserved rights. <br />4.7 DIMENSIONS <br />Figured dimensions on the plans will he used in preference to scaling the <br />Drawings. Any conflicts, ambiguity, or discrepancy, shall be immediately <br />brought to the attention of the Engineer before proceeding with the affected <br />Work. Contractor shall assume the risk of loss for failure to bring to the <br />attention of the Engineer such conflict, ambiguity, or discrepancy. <br />SECTION 5 <br />AVAILABILITY OF LANDS; PHYSICAL <br />CONDITIONS; REFERENCE. POINTS <br />5.1 AVAILABILITY OF LANDSY <br />5.1.1 Owner shall furnish, as indicated in the Contract Documents, the lands <br />upon which the Work is to be performed, righta-of-way for access thereto, and <br />such other lands which are designated for the use of Contractor. Easements <br />for permanent structures or permanent changes in existing facilities will be <br />obtained and paid for by Owner, unless otherwise provided in the Contract <br />Documents. <br />5.1.2 Contractor shall, at his expense, <br />provide for a'1 additional lands and <br />access thereto that may be required <br />for <br />temporary construction facilities or <br />storage of materials and <br />equipment. <br />Contractor shall confine his machinery <br />and equipment, storage of <br />materials <br />and <br />operation of workmen to those areas <br />described in the Contract <br />Documents <br />and <br />such additional areas which he may <br />provide at his expense. <br />5.2 PRIVATE PROPERTY <br />The Contractor shall not enter upon private property nor any purpose without <br />obtaining written permission from the owner thereof, and he shall be relpon- <br />sibie for the, preservation of al? property, trees, monuments, etc., along and <br />adjacent to the street and/or right-of-way, and shall use every precaution <br />1 /85 - m5h <br />Copyr+ght 1985 <br />Bnnestroo, Roaene, Anderlik <br />& A1snrlateq, [nr. <br />
