duties and responsibilities of owner, Contractor or Engineer, or any of their <br />agents or employees from those set forth in the Contract Documents. Clarifi- <br />cations and interpretations of the Contract Documents shall be issued by Engi- <br />neer as provided for in Paragraph 4.4. <br />4.1.4 The Contract Documents shall be governed by the law of the place of the " <br />Pro.lect. <br />4.2 ORDER OF PRECEDENCE <br />If there be a conflict between or among any of the terms or provisions of the <br />Contract Documents, which conflict cannot be reconciled by resorting to the <br />intent of the Contract Documents under Paragraph 4.1, the conflict shall be <br />resolved by applying the following Order of Precedence: <br />(a) Agreement; <br />(h) Conditions of the Contract; <br />(c) Special Provisions; <br />(d) Specific Requirements; <br />(e) General Requirements <br />(f) Drawings. <br />4.3 DISCREPANCIES <br />Any conflict, ambiguity or discrepancy in the Contract Documents, no matter <br />how seemingly insig.lificant to the Contractor, shall be brought immediately to <br />the attention of the Engineer for clarification. Any Contractor who fails to <br />bring any conflict, ambiguity or discrepancy to the attention of the Engineer <br />of which it was or should have been aware, shall assu:,se the risk of loss aris- <br />ing out of any such conflict, ambiguity, or discrepancy. <br />4.4 ADDITIONAL INSTRUCTIONS <br />Further or additional instructions may be issued by �- ",igineer during the <br />progress of the Work by the use of Drawings or other a,4 to clarify the <br />intent of the Contract Documents or to explain or illu� ite Changes in the <br />Work or Field Orders. <br />4.5 DRAWINGS AND SPECIFICATIONS AT JOB SITE. <br />Contractor shall keep one record copy of all Specifications, Drawings, <br />Addends, Modifir•stions , Shop Drawings and samples at the site, in good order <br />and annotated to show all changes made during the construction process.
