H. "Association" -shall mean Orono Oaks Association, <br />0 Inc., a Minnesota non-profit corporation. <br />I. "Member" shall mean any Owner who is a member of <br />the Association as provided herein. <br />J. "Declarant" shall mean Ralph Carlson Companies, <br />Inc., a Minnesota corporation, its successors and assigns if such <br />successors or assigns should acquire more than one undeveloped Lot <br />from the'De6larant for the purpose of development. <br />K. "Declaration" shall mean and refer to this <br />Declaration of Covenants, Conditions and Restrictions. <br />2. Easements. Every Owner shall have a non-exclusive <br />right and easement for ingress and egress to his Lot and for utility, <br />water, drainage and sewer installations serving -his Lot, over and <br />upon the Common Roadway and for utility, water, drainage and sewer <br />• installations serving his Lot, over and upon the Utility and Drainage <br />Easements. In addition, every Owner shall have a non-exclusive right <br />and easement for drainage purposes over and upon the Drainage Easements. <br />The Owners of Lots'9, 10, and 13 shall each have a non-exclusive right <br />and easement for ingress and egress to his Lot and for utility, water <br />and sewer installations serving his Lot, over and upon the Common <br />Driveway. The rights and easements hereby granted shall be appurtenant <br />to and shall pass with the title to every Lot, and shall be subject <br />to the following conditions: <br />A. The right of the Association to pass reasonable <br />rules with respect to the use of the Common Roadway, Common Driveway <br />and other easements for the health, comfort, safety and welfare of <br />persons using the same. <br />B. The right of the Association to levy assessments <br />as provided in this Declaration; <br />C. The rights of the Association, Declarant and City <br />of Orono reserved hereinbelow. <br />Any Owner may delegate in accordance with the By-laws of <br />the Association his rights of enjoyment herein granted to residents <br />of his Lot, including members of his family, his tenants or contract <br />-16 purchasers. <br />-3- <br />
