ORONO POLICE DEPARTMENT - DEPARTMENT MANUAL <br />500. 12 (A) <br />Purpose: The purpose of this Order is tc, establish guide- <br />lines for officers when using electronic device in an <br />official capacity. <br />Authorization <br />A. Sworn officers in an on -duty capacity may carry an <br />electronic device when such a device has been <br />approved for use by the Chief of Police. Carrying <br />an electronic device is optional: however, any <br />officer who elects to carry such a device may do <br />so only after receiving training on its use. <br />B. The Nova XR-5000 (stun gun) manufactured by Nova <br />Technologies, is hereby authorized for use by <br />Orono Police Officers. The stun gun is a non -lethal <br />hand held device that has a power source consisting <br />of a 9 volt battery. <br />Conditions of Use <br />A. The stun gun may be employed by an officer against <br />another person without that person's consent in <br />situations where the use of reasonable force is <br />authorized consistent with M.S.S. 609.06, and then <br />only when that person is physically resisting the <br />officer's efforts, or in in the act of -aulting <br />another person. <br />1. M.S.S_ 609.06 - AUTHORIZED USE OF FO;t_. <br />Reasonable force may be used upon or toward <br />the person of another without their consent <br />when the following circumstances exist or the <br />actor reasonably believes them to exist: <br />a. When used by a public officer or ore <br />assisting nim unde nis direction: <br />(1) In effecting a lawful arrest, or <br />(2) In the execution of legal process? or <br />
