This procedure is not to he construed as eliminating from <br />competition other products of equal or better quality by other <br />OMmanufacturers <br />where fully suitable in design unless otherwise specifically <br />i <br />stated in the Specifications or Special Provisions. <br />4.12.2 The Contractor shall furnish the complete list of proposed desired <br />substitutions prior to executing the Agreement. together with such <br />I <br />engineering and Product Data as the Engineer may require. <br />A <br />4.12.3 The Contractor shall abide by the Engineer's recotmncndation when <br />proposed substitute materials or item, of equipment are not recommended <br />for installation and shall furnish the specified material or item of <br />equipment in such case. All proposals fur substitutions shall be <br />submitted in writing by the General Contractor and not by individual <br />t' <br />trades or material suppliers. The Engineer will review proposed <br />substitutions and make his recommendation in writing within a reasonable <br />: <br />time. <br />t� <br />4.13 FURNISHING OF PRODUCT DATA <br />t� <br />4.13.1 The Contractor shall furnish one copy of complete Product Data for <br />every manufacturered item of equipment and all components to be used in <br />the Work, including specific performance data, material description, <br />rating, capacity, working pressure, material gage or thickness, brand <br />s� <br />name, catalog number and general type. <br />4.13.2 This data shall be compiled by the Contractor and reviewed by the <br />Engineer before any of the equipment i� ordered. <br />4.13.3 All data shall be indexed according to specification section and <br />paragraph for easy reference. <br />4.13.4 After review, this data shall become a part of the Contract, and <br />may not be deviated from except upon written approval of the Engineer. <br />4.13.5 Product Data for equipment reviewed by the Engineer does not in <br />any case supersede the Contract DocumenrA. The review by the Engineer <br />shall not relieve the Contractor from responsibility for deviations from <br />Drawings or Specifications unless he has in writing called the Engineer's <br />attention to such deviations at the time of furniRhing said data. Nor <br />shall such review relieve the Contractor from responsibility for errors of <br />any sort in *the items furnished. The Contractor shall check the Work <br />described by the Product Data with the Contract Doctmtents for deviations <br />and errors. <br />4.13.6 It shall be they responsibility of the Contractor to insure that <br />items to be futnished fit the space available.
