d. In residential districts fences along rear lot lines or <br />along side lot lines in rear of the rear building line of the <br />principal structure shall not exceed six (6) feet in height, <br />except as otherwise regulated in subsection P12.06(e). <br />e. Should the rear lot line of a lot in a residential district <br />be common with the side lot line of an abutting lot, that portion <br />of the rear lot l ,:e equal to the required front yard setback of <br />the abutting lot shall be fenced in accordance with the provision - <br />of subsection 812.06(c). <br />f. Where a property line is not clearly defined, a certificate of <br />survey may be required by the City Manager to establish said line. <br />812.07. Fences within required y,rds. Fences shall be permitted within <br />required yard areas subject to the following specific provisions: <br />a. In commercial and Institutional districts fences located <br />within non -buildable setback areas shall not exceed a heigh, <br />of six (6) feet from the adjacent finished grade. <br />b. In residential districts fences located within front yard <br />or side yard setback areas in front of the rear building line <br />of the principal structure shall not exceed forty-two (42) inches <br />In height, and no more than fifty percent (502) of any such fence <br />shall be solid mattcr. <br />JC. In residential districts fences located within side yard, rear <br />yard or lakeshore setba s in rear of the rear building line <br />of the principal structure shall not exceed six feet Sn height. <br />d. Fences located within the buildable side yard or rear yard in <br />rear of the rear building line of the principal structure shall not <br />exceed eight (8) feet in height. <br />812.08. Apprals. <br />a. 'Purpose. A modification or variance from the strict terms of <br />this (',dpter may be permitted to provide relief on an Individual <br />basis. The conditions controlling the consideration of such a <br />modification shall be established by the provisions of this Section. <br />b. Application procedure. An application for a modification shall <br />be submitted to the City Manager, together with the required support- <br />ing data and a statement indicating how the requested modification <br />will meet the criteria used in evaluating such requests. A fee of <br />Five Dollars ($5.00) shall accompany the application. Once such <br />an application is complete, the Citv Manager shall schedule the <br />request before the City Council. <br />812-3 <br />
