C. Criteria for approval. The City Council may approve a modifica- <br />tion upon a finding that the requested modification will meet each <br />of the following criteria, although it shall not be required to do so: <br />(1) There are exceptional or extraordinary circumstances <br />or conditions anplyinp to the property and/or fence structure(s) <br />In question, which circumstances or conditions do not apply <br />generally to property and/or fence structures within the City. <br />(2) Undet the circumstances of the particular situation the <br />modification will not adversely affect the health, safety or <br />general welfare of residents of the surrounding area or of <br />the community as a whole. <br />817-4 <br />
