812.05. General provisions. Fences shall be permitted in all zoning <br />Cdistricts within the City, subject to the following general provisions and <br />subject to such specific provisions of Sections 812.06 and 812.07 as shall <br />apply: <br />a. No fences shall be permitted on public rights -of -way. <br />b. No fences over eight (8) feet in height from the adjacent <br />finished grade shall be permitted, except that chain link fences <br />up to ten (10) feet in height surrounding tennis courts may be <br />approved by the City Council. <br />c. All fences over forty-two (42) inches in height or located on <br />or within three (3) feet of a property line shall require a permit <br />under this Chapter. Said permit may be issued by the City Manager <br />if all requirements of this Chapter have been met. <br />d. That side of any fence considered to be its "face" (i.e., the <br />finished side having no structural supports) bh211 face abutting <br />property. <br />e. Both sides of any fence shall be maintained in a responsible <br />condition by its owner. <br />f. Barbed wire fences shall be permitted only in outlying areas <br />of the City where such fences are used to enclose pastures or farms <br />of considerable acreage. All such fences shall require approval of <br />the City Council, upon a showing that the fence is required for its <br />intended purpose, and no such 'once shall exceed five (5) feet in <br />height. <br />g. No person shall construe nr maintain or allow to be constr-icted <br />or maintained anywhere within the City any fence of metal construction <br />which is charged by or connected with an electrical aystem. <br />812.06. Fences along property lines. Fences shall be permitted on or <br />within three (3) feet of a property line subject to the following specific <br />provisions: <br />a. No physical damage of any kind shall occur to abutting property. <br />b. In commercial and institutional districts fences shall not <br />exceed a height of six (6) feet from the adjacent finished grade. <br />C. In residential districta fences along front lot lines or along <br />side lot lines in front of the rear building line of the principal <br />structure shall not exceed forty-two (42) inches in height, and no <br />more than fifty percent (50%) of any such fence shall be solid <br />matter. <br />812-2 <br />
