City of ORONO RESOLUTION OF THE CITY COUNCIL NO. 4. The subdivider has dedicated to the City a road and utility easement granting to the City access, improvement and utility rights over that portion of the temporary cul de sac not included in the dedicated right of way of Countryside Drive. 5. All five lots created by the current plat, Countryside Manor 2nd Addition, will be subject to the same restrictive covenants filed ,against Outlot A, Countryside Manor that advises all future benefitting property owners of their share in the responsibility of the maintenance and repair of Countryside Drive until that time in the future when the subject road is a through road connected to Old Crystal Bay Road South. The covenants further advise that at. the time of the City's acceptance of Countryside Drive that it will he the benefitting property owner's responsibility to bring that road up to current City standarcls. 6. Dedication to the City of a Flowage and Conservation Easement providing for limitations on the use of wetlands and/or drainageways described therein and shcwn on the plat as "drainage easements". 7. Execution of a Subdivider's Agreement providing for installation of certain improvements as a condition of subdivision approval. 8. Payment to the City of a Park. Dedication Fee in the amount of $1,000.00. 9. Payment to the City for the legal review and filing of the plat, easements and covenants in the amount of $75.00. NOW, THEREFORE, BE IT RESOLVED, that the City Council of the City of Ororo hereby approves the plat of Countryside Manor 2nd Addition, Hennepin County, Minnesota; subject to the following conditions: 1. Road beds of Manor Circle, extension of Countryside Drive, and the retention pond located within Lots 1 and 2, Block 3 must be installed and approved by the City before the Building Department. can issue a buildinq permit for new construction. 2 of 3
