"The variance, if granted, will not alter the essential character of the locality." <br />The property will undergo additional development with a replacement structure including a new home & <br />garage structure which replaces the existing home & garage. The proposed new construction will be <br />essentially located in the same place as the existing home & garage structure to be revised to meet or <br />improve present setbacks, meet maximum height requirements, and structural coverage requirements , <br />preserving and improving the essential character of the locality. · . <br />4. "Economi~ considerations alone shall not constitute an undue hardship if reasonable use for the <br />property exists under'the terms of the Zoning Chapter." <br />Economic considerations are not any significant reason for redevelopment and the granting of variances . <br />The primary reason for this request are: <br />a. Deteriorated structural , energy efficiency, construction and functional obsolescence. <br />5. "Practical difficulties include, but is not limited to, inadequate access to direct sunlight for solar <br />energy systems. Variances shall be granted. for earth sheltered construction as defined in <br />Minnesota Statutes, Section 116J.06, Subd. 2, when in harmony with this Chapter." <br />This is not a reason for the variances requested or some of the existing non-conformities to be continued. <br />6. "The Board of Appeals and Adjustments or the 'Council may not permit as a variance any use that <br />is not permitted under this Chapter for property in the zone where the affected person's land is <br />\ . <br />located." . <br />This request is consistent with the present allowed uses under the ordinance. <br />7. "-The Board or Council may permit as a variance the temporary use of a one-family dwelling as a <br />two-family dw-elling." <br />Does not apply. <br />8. "Th_e special conditions applying to the structure or land in question are peculiar to such property . <br />or immediately :adjoining property." - <br />The exact conditions of this property are unique to this property, and have some similar aspects of <br />adjoining property, i.e., lots of non-conforming widths, road frontages , sizes, etc., yet lot specifics are <br />uniquely differing to those adjacent properties. <br />9. "The conditions do not apply generally to other land or structures in the district in which said <br />land is located." · <br />The exact conditions .do not apply generally to other land and structures in the District.
