"The granting of the application is necessary for .$he preservation and enjoyment of a substantial <br />property right of the applicant." <br />Granting of the variances requested is necessary to put this specific property to a reasonable use equal to <br />the preservation and enjoyment of the present substantial existing and owned property rights. <br />11. "The granting of the proposed variance will not in any way impair health, safety, comfort, morals, <br />or in any other respect be contrary to the intent of the Zoning Code." <br />Granting of the variances requested will not impair bu{ improve the owner's and neighborhood's health, <br />safety, comfort. quality of the lake experience life, and qualitatively improves the City of Orono's <br />housing stock. In no way is this granting contrary to the intent of the zoning code of MN State Statutes <br />but in fact. .. the continuance and reduction of non-conformities will only enhance the· above <br />characteristics. · <br />12. "The granting of such variance will not mei-ely serve as a convenience to the applicant, but is <br />necessary to alleviate demonstrable difficulty." · ' <br />Granting of the _variances requested has nothing to do with convenience to the applicant. As <br />demonstrated above, variap.ces are required due to unique physical aspects of the property and the <br />owner's health, safety, welfare, and improvement due to deteriorated structural conditions. <br />-Hardship Statement: <br />· Physical and practical difficulties fqr reuse of this unique piece of property exist relative to present day <br />zoning ordinance requirements. This property would not be a permitted subdivision under the current <br />zoning ordinance and meet all of its requirements, resulting in characteristics that allow hardships to exist. <br />Combine this with a property configuration, including length and narrowness, which generates additional <br />non-conformities related to hardcover of structures. The owner also desires to improve existing non- <br />conformities, including no increase to existing structural coverage, hardcover reduction and impro ving the <br />roadside/front yard setback. In summary, it is not possible to avoid a variance request by the nature of this <br />legal non-conforming lot and its physical characteristics, and redevelop deteriorated aspects of t4e property <br />to a reasonable and similar use that presently exists. · <br />' . <br />Sincerely, <br />·Michael D.
