MEMORANDUM <br />TO. William R. Soth <br />FROM: Matthew B. Seltzer 1VV140000 <br />RE. City of - review of plat for Bayside Woods <br />DATE. December o, ,989 <br />I have reviewed the plat of Bayside Woods submitted <br />to you by letter of November 29, 1989 from Michael P. Gaffron <br />of the City of Orono. <br />1. My review has been limited to Chapter 505 of <br />Minnesota Statutes. I assume that the City has seen that <br />the plat complies with the Orono subdivisijn and platting <br />ordinances. <br />2. The materials received from t'-ie City include <br />a Resolution No. 2728 adopted November 13, 1989. I am unable <br />to comment on whether the legal and factual findings in the <br />Resolution are correct and consistent with the City'z ordinances. <br />3. Also included in the package is a Flowage and <br />Conservation Easement for recording. As noted in Mr. Gaffron's <br />cover letter, the notary acknowledgement forms on that document <br />are incomplete. The document should be re -executed with <br />proper acknowledgements. Also, the document should be revised <br />in the first paragraph on page 1 to indicate that it is made <br />by "Maurice R. Taylor II and Cheryl L. Taylor, husband and <br />wife, fee owners, and the Landschute Group Inc., a Minnesota <br />corporation, contract purchaser." The document should be <br />filed immediately after the plat. <br />4. Minn. Stat. §505.03 requires the submission <br />of an abstract and certificate of title. In lieu of an abstract, <br />a title commitment has been provided. I recognize that this <br />is a common practice in many municipalities, but it does <br />not follow the exact letter of the statute. According to <br />the Registrar of Titles, the Owner's Duplicate Certificate <br />of Title is at the courthouse. <br />5. I assume that all proper procedures were followed <br />for approval of the preliminary plat.
