HERZUCK <br />MAR 1 ·s 1993 <br />Enclosed you will find my title opinion for use by the City for <br />platting purposes, together with copies of the recent redrafts of <br />the covenants. Those redrafts take into account the requirements <br />of the John Burger subdivision, as well as the Austin Evans <br />subdivision. I believe you will find them satisfactory in all <br />respects. They have been recorded . The document numbers are <br />listed in the attached letter from Jeffrey L . Watson. I verified <br />this fact when I did my tract check on Tuesday, March 9, 1993. <br />As to the seven items listed as conditions in your preliminary <br />approval , I will respond in the order that they are numbered: <br />1. This item would be covered by the amended covenants. <br />2. This item is covered by Private Easement Agreement with <br />Vickie Ross who has since sold her property. Those <br />documents, along with the fee to be paid are held in <br />escrow, pending approval of the plat of Burger's Bayside <br />Second Addition. By sending a copy of this letter to <br />Laurie Meyer-Hunt, I will ask that she obtain copies of <br />those easement documents and send them to you. In that <br />regard, you should also note that it would necessary to <br />have an access over the Outlet that serves the Ross <br />parcel, and that is covered by those documents as well. <br />3. I presume the City will be drafting the lot combination <br />agreement.
