Zoning File #1.310 <br />august 8, 1988 <br />Page 2 of 2 <br />Renewal of Application #1103 - <br />The original conditional use permit approved the filling of the former <br />dump site on the Eisinger property, totalling 12 acres in area, to a <br />maximum of 100,000 cubic yards of clean fill from the I-394 improvement <br />project (review Exhibits E, G, H, and I). Council accepted the Planning <br />Commission and staff recommendati.an to limit fill to a maximum of 100,000 <br />cubic yards resulting in no more than a 5' overall increase in height from <br />the existing eleva'C4ons at the dump site. As proposed, all filling would <br />take place approximately 35' from the designated wetland area that <br />surrounds the dump site on both the east and west sides. <br />Resolution #2192 reviews the limits of the land alterations approved <br />with the application and also sets forth the guidelines by which the fill <br />project will be maintained by the applicant, under the supervision of the <br />City ..taff's inspections. Staff has reviewed those original conditions. It <br />is not clear how long the City will allow exposed earth to remain on the <br />pruperty prior to the final grading and seeding. Consider the application <br />that involved the filling of a 11' high berm on County Road 6 in the <br />western part of the City. The filling began over a year ago and the berm <br />has remained in a disturbed condition for over a year. Staff is <br />concerned that once this filling project begins, `here may be lapses in <br />time where exposed sections of earth remain at the site for long pericds of <br />time. There will of course be adequate erosion control provided throughout <br />the project. The resolution should provide clear guidelines for the staff <br />responsible for supervising this project, when areas remain with fill <br />unattended for over 30-60 day periods of time, staff should either be <br />directed to bring the application before the Council for further direction <br />or to immediately require applicant to complete the final grading of the <br />area and seed immediately. It may be that these concerns are not valid, as <br />once the filling begins on a project this size, there may be no delays in <br />th- hauling of the materials. The applicant and the representative from <br />Par Construction.
