3. The Orono Planning Commission reviewed this application on May 16, <br />1988 and unanimously recommended approval of the conditional use <br />permit and variances sought by the applicant and as noted above, based <br />on the following findings: <br />A) The non-profit club use of this severely limited property <br />located within the rural unsewered areas of the City is an ideal. <br />use based on the limited septic demands of the club. <br />B) The applicants have agreed to close off the access at Old <br />Crystal Bay Road. Such access could never meet the safety <br />distance separation setback from the intersection of Fox Street <br />and Old Crystal Bay Road. <br />C) The majority of the side and front street yards will be <br />maintained as grassed areas with the proposed site improvements. <br />D) The City has received no negative comments or objections from <br />any of the surrounding neighbors nor are there any records of <br />previous complaints by the neighbors regarding the current use of <br />the property. <br />E) The current use has existed on this property for <br />approximately 10 years. <br />5. The City Council finds that the conditions existing on this pro- <br />perty are peculiar to it and do not apply generally to other property <br />in this zoning district; that granting the variance would not <br />adversely affect traffic conditions, light, air nor pose a fire hazard <br />or other danger to neighboring properties; would not merely serve as a <br />convenience to the applicant, but is necessary to alleviate a demon- <br />strable hardship or difficulty; is necessary to preserve a substantial <br />property right of the applicant; and would be in keeping with the <br />spirit and intent of the Zoning Code and Comprehensive Plan of the <br />City. <br />6. The City Council finds that granting a conditional use permit to <br />allow the continued private non-profit club ise by Minnetonka Alano <br />Group, Inc. will not be detrimental to the health, safety or general <br />welfare of the public, would not adversely affect light, air nor pose <br />a fire hazard or other danger to neiyi,horing projerties, nor will it <br />depreciate surrounding property values avid that the proposed level of <br />use of the property will be in keeping wit' the intent and objectives <br />of the Zoning Code and Comprehensive Plan of thf!
